ACCEPTANCE

Instructions and requests for travel information received by Travel Excellence from you (our Customer) including travel locations, cruises, flight details, dates and prices, accommodations, land transportation, insurance, currency and services shall constitute acknowledgement by the Customer that it has received and agrees to these conditions and will be bound by them and will authorize Travel Excellence to act on behalf of the customer in Accordance with the Condition. Specific clauses below which exclude or limit Travel Excellence’s liability and limit the time for bringing claims against Travel Excellence are found in this text. These conditions are intended to have the effect of contracting out any applicable provisions of current laws in each of the Provinces and Territories of Canada, except to the extent permitted by those laws where applicable. These Conditions shall be read as subject to such legislation and nothing in these Conditions shall be construed as a surrender by Travel Excellence of any of its rights or immunities or as an increase of any of its responsibilities under such legislation.

TRAVEL INFORMATION

Travel Excellence acts as an agent only and the Customer hereby expressly authorizes Travel Excellence to enter into all and any contracts on behalf of the Customer as may be necessary or desirable to fulfill the customer’s instructions and provide the Services. As an agent, Travel Excellence does not make any contract with the customer for the provision of services other than the agency services. Travel Excellence establishes contract with third-party service providers on behalf of the Customer to provide a relationship between the customer and the Third-party. By placing a deposit and/or final payment on your reservation, you are accepting the terms and conditions of such third parties and you are advised to familiriaze yourself with these terms and conditions carefully.

PRICES

Unless otherwise stated by Travel Excellence, the price for any booking is not guaranteed. All prices quoted are subject to availability and can be withdrawn or varied without notice. Price changes may occur because the third-party providers may change the prices at any time or because of matters outside our control which increase the cost of the product or service such as currency fluctuations, fuel surcharges, taxes and fare increases. All amounts quoted are payable in the currency in which they were quoted. Any exchange fees applied to a charge and imposed by your credit card company are beyond Travel Excellence’s control. Other than any Travel Excellence fees if applicable, all other monies received by us from the Customer are received by us as an agent for the third-party service provider. If for any reason a third-party provider is unable to provide the services for which you have contracted, your rectification lies against that third-party service provider and not Travel Excellence.

INSURANCE

Travel Excellence strongly recommends that all Customers purchase travel insurance to cover their travel arrangements and provide adequate coverage for medical expenses, personal accident, loss of baggage and trip cancellation and delay. It is the Customer’s Responsibility to ensure travellers have adequate travel insurance for their journey. Travel Excellence will provide you with the options based on each customer’s individual needs. Should the Customer decline insurance, Travel Excellence will request that a waiver be signed before your travel documents are released by your advisor.

TRAVEL DOCUMENTATION

All travellers must have a valid passport and/or visa for international travel and many countries require at least 6 months validity from the date of return. The Customer agrees to ensure that all travellers’ passports and visas are in order. Please make sure that the spelling of all names provided to Travel Excellence regarding the services are as they appear on your passport. Name changes, if permitted, may be subject to penalties according to the travel supplier. Passport, Visa and Health requirements are the responsibility of the Customer and all individual travellers. To re-enter Canada, you must carry a valid passport, a Valid Permanent Resident Card or Valid Visa/Work Permit. These are guidelines only provided by Travel Excellence in good faith and the final responsibility for ensuring documentation is correct is that of the Customer and the individual travellers. Any fines, penalties, payments or expenditures incurred as a result of such travel documents not meeting the requirements of those authorities will be the Customer’s sole responsibility. The Customer acknowledges and agrees that all travellers are liable for any customs duties or other charges levied by the government authorities against the travellers in relation to any travel arrangements and that no claims can be made in respect to such duties and charges against Travel Excellence. We recommend that your inquire with the Affairs Bureau for Canadian abroad or visit www.travel.gc.ca to confirm your personal travel requirements. International Driver’s Permit and Insurance may also be required by some countries, we recommend to obtain the latest up to date information and entry requirements prior your departure.

HEALTH AND VACCINATIONS

In some cases, international health certificates are required and failure to present required vaccination and health documentation may deny travellers entry into a country. Travel Excellence recommends that travellers consult with their local doctor, medical centre or vaccination clinic before commencing travel. The Customer must ensure that travellers are aware of any health requirements required for their destination as it is their sole responsibility.

AMENDMENT AND CANCELLATIONS

Cancellations and changes to your travel arrangements may incur charges. These charges can be up to 100% of the cost of the booking whether travel has commenced. Fees and extra charges may also apply where a booking is changed and documents are re-issued. Where Travel Excellence incurs any liability for a supplier cancellation fee for any booking which the Customer cancels or changes, the Customer agrees to indemnify Travel Excellence for that fee or charge. Travel Excellence is responsible to collect any increases on the cruise line or supplier’s behalf. Cruise lines reserve the right to change their itinerary when necessary. Local tax and surcharges charged at some airports are payable by the traveller.

SCHEDULE CHANGES

Travel Excellence does not have any control over air flights, times, seat selection or carriers that are part of all inclusive air/sea package. Flight schedules are determined by the airlines, suppliers and cruise lines. If you have certain requirements that must be met concerning your flights, we recommend you inquire about air deviation at an extra cost.

PAYMENTS

If payments are not received by the applicable due date, reservations are subject to cancellation and sums paid may by forfeited. All airfares and tour/cruise operator rates are subject to change without notice if full payment for the booking has not been received. Travel Excellence requires cancellations be made in writing.

FORCE MAJEURE

Travel Excellence does not accept liability where the performance of our contractual obligations is prevented or affected, or customer otherwise suffer any loss, injury, death, inconvenience or damage as a result of circumstances amounting to ‘FORCE MAJEUR’. These are events and circumstances which Travel Excellence or the travel supplier could not foresee or avoid. Such events/circumstances may include but are not limited to Pandemics, Epidemics, Quarantine, Sickness or the threat thereof government intervention, war or threat of war (declared or undeclared), terrorist activity or the threat thereof, invasion, mobilization, embargo, civil disturbance, riots, strikes, industrial action, civil action, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, delay, acts of God, tidal waves, tsunami, flood, wind events, earthquakes, forest fire, weather conditions, volcanic eruptions and all similar events outside our control.

LIABILITY AND LIMITATIONS

The Customer acknowledges and agrees Travel Excellence is not liable in contract for any injury, damage, loss, delay or events caused by Force Majeure or any additional expense or inconvenience caused by the errors, omissions or default of third service party providers. If for any reason any third-party service provider is unable to provide the services for which the Customer contracted, the customer agrees to make claims only against the third-party service provider and further agrees not to make any claim against Travel Excellence unless the claim arises solely because of Travel Excellence’s gross negligence. Travel Excellence’s liability may also be limited to the extent that any other relevant law or convention limits the travellers compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. (Athens convention, Berne Convention and Paris Convention) subject to applicable laws, any claim by the Customer against Travel Excellence arising in respect of any services provided for the customer, or which Travel Excellence has undertaken to provide, shall be made in writing and notified to Travel Excellence within twenty-eight days of the date upon which the Customer became or ought reasonably to have become, aware of any event or occurrence alleged to give rise to such claim, and any claim not made and notified as aforesaid shall be deemed to be waived and absolutely barred.

PRIVACY POLICY

By providing personal information to Travel Excellence, the Customer consents to Travel Excellence collecting, using and disclosing the customer’s and all travellers’ personal information. The Customer agrees that Travel Excellence is permitted to transfer personal information to third-party service providers and for international travel to overseas recipients. Such recipients include travel service providers with whom the Customer seeks to make a booking and government authorities and other agencies responsible for the related security or other relevant measures. Travel Excellence will not be required to ensure the recipient’s compliance with Canadian and Foreign privacy laws or otherwise accountable for how the recipient handles the personal information. These Conditions shall be governed and construed according to the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute, controversy or claim arising out of, relating to or regarding these Conditions or the services, including any question regarding existence, validity or termination of these Conditions, shall be referred to the exclusive jurisdiction of the Courts of the Province and any Courts competent to hear appeals therefrom
